1. Agreement to Terms

By accessing or using PromarkSEO's website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Description of Services

PromarkSEO provides:

• Search Engine Optimization (SEO) consulting and implementation
• Website audits and technical SEO services
• Content optimization and strategy
• Link building and digital PR
• Analytics setup and reporting
• Related digital marketing services

3. Account Registration

To use certain services, you must:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of unauthorized access

4. Payment Terms

Pricing

All prices are in USD. One-time services are invoiced per project schedule and may require an upfront deposit before work begins. Monthly services are billed in advance each billing cycle.

Refunds

We do not offer outcome-based refunds for rankings, traffic, leads, or revenue. If PromarkSEO misses a scoped deliverable and does not cure it within a reasonable period, the remedy is re-performance or a proportional credit for the unperformed portion. Completed work and reserved capacity are non-refundable.

5. Our Satisfaction Guarantee

We commit to delivering agreed scope with clear documentation and communication. If we miss a scoped deliverable, we will correct it or provide a proportional credit for the unperformed portion.

6. Service Expectations

No Guarantees

SEO results vary based on many factors. We cannot guarantee specific rankings, traffic numbers, or business outcomes. We promise best-effort services using industry best practices.

Timeline

Turnaround times are estimates. Delays may occur due to factors beyond our control (third-party platforms, client feedback cycles, technical issues).

7. Client Responsibilities

Clients must:

• Provide timely access to websites, analytics, and necessary accounts
• Respond to requests for information within reasonable timeframes
• Review and approve deliverables promptly
• Maintain website functionality and hosting
• Not interfere with our SEO work without consultation

8. Intellectual Property

Upon full payment, clients own deliverables created specifically for them (content, reports, etc.). We retain ownership of our methodologies, tools, templates, and general knowledge.

Clients grant us permission to use their website as a case study (with prior approval) and display their logo in our portfolio.

9. Confidentiality

Both parties agree to keep confidential information private. This includes business data, strategies, analytics, and proprietary information shared during our engagement.

10. Termination

By Client

Monthly services can be cancelled before the next billing cycle by written notice. One-time projects may be terminated for convenience, but payment remains due for work performed and committed capacity.

By PromarkSEO

We reserve the right to terminate services for: non-payment, violation of terms, abusive behavior, or if we determine the engagement is not a good fit.

11. Limitation of Liability

PromarkSEO is not liable for indirect, incidental, consequential, or punitive damages. Our total liability is limited to the amount paid by the client in the 3 months preceding the claim.

12. Indemnification

Clients agree to indemnify PromarkSEO against claims arising from: client's use of our services, violation of these terms, or infringement of third-party rights.

13. Dispute Resolution

Any disputes will first be resolved through good-faith negotiation. If unresolved, disputes will be settled through binding arbitration in Las Vegas, NV, under American Arbitration Association rules.

14. Changes to Terms

We may modify these terms at any time. Changes will be posted with an updated date. Continued use of services after changes constitutes acceptance of new terms.

15. Governing Law

These terms are governed by Nevada law, without regard to conflict of law provisions. Exclusive jurisdiction and venue are in Las Vegas, Nevada.

16. Brand Notice

PromarkSEO is an independent company and is not affiliated with other Promark-branded businesses.
